1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Bazaario LLC, a Texas limited liability company ("Bazaario," "we," "us," or "our"), governing your access to and use of the Bazaario website and online marketplace located at bazaario (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Products and Pricing

All products listed on the Service are subject to availability. We reserve the right to modify, discontinue, or limit the quantity of any product at any time without prior notice.

Prices for products are listed in United States Dollars (USD) and are subject to change without notice. We make every effort to ensure pricing accuracy, but errors may occur. In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price.

Product descriptions and images are provided for informational purposes only. While we strive for accuracy, we do not warrant that product descriptions, images, or other content on the Service are error-free, complete, or current.

4. Orders and Payment

When you place an order through the Service, you are making an offer to purchase the products in your order. All orders are subject to our acceptance, which we may withhold at our sole discretion.

Payment is processed securely through Stripe, our third-party payment processor. By providing payment information, you represent and warrant that you are authorized to use the payment method provided. You agree to pay all charges associated with your order, including applicable taxes and shipping fees.

5. Shipping and Delivery

Shipping times and costs vary based on the products ordered and the delivery destination. Estimated delivery times are provided at checkout and are not guaranteed. Bazaario is not responsible for delays caused by carriers, customs, or other factors outside our control.

Risk of loss and title for products purchased pass to you upon delivery to the carrier.

6. Returns and Refunds

Our return and refund policy is described in our Refund Policy, which is incorporated into and forms part of these Terms.

7. Intellectual Property

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, and design) are owned by Bazaario LLC, its licensors, or other providers and are protected by United States and international copyright, trademark, and other intellectual property laws.

8. Prohibited Uses

You agree not to use the Service:

  • In any way that violates any applicable federal, state, local, or international law or regulation
  • To transmit any advertising or promotional material without our prior written consent
  • To impersonate or attempt to impersonate Bazaario, a Bazaario employee, or any other person
  • To engage in any conduct that restricts or inhibits anyone's use of the Service
  • To introduce viruses, trojan horses, worms, or other malicious material
  • To attempt to gain unauthorized access to any part of the Service

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BAZAARIO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

10. Indemnification

You agree to defend, indemnify, and hold harmless Bazaario LLC and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the federal courts of the United States or the courts of the State of Texas, and you consent to the personal jurisdiction of such courts.

12. Changes to Terms

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.
